Termini e condizioni generali

“ByWay” indica il servizio di digitalizzazione e scambio di dati tra diversi soggetti attraverso il web secondo i presenti termini e condizioni generali stabiliti dall’azienda ByWay srl sita in via Ipazia 2, 39100 Bolzano – Italia (di seguito chiamata la società). 
Nei presenti termini e condizioni generali relativi alla protezione dei dati e dei documenti, Le verrà spiegato il trattamento riservato ai suoi dati personali e come può condividerli con altri utenti del servizio "ByWay".

1. Principi fondamentali di "ByWay" riguardo al trattamento dei suoi dati personali

Per proteggere i suoi dati personali, la società osserva strettamente i seguenti principi fondamentali:

• La società raccoglie e gestisce i suoi dati personali in conformità con le leggi e le norme riguardanti la protezione dei dati della Repubblica Italiana e dell'Unione Europea.
• La società utilizza i suoi dati personali esclusivamente al fine di fornirLe i servizi della piattaforma ByWay per i quali si è registrato.
• La società potrà utilizzare i sui dati in forma anonima per effettuare statistiche per conto di terzi.

2 Dati di registrazione

Per usufruire del servizio di condivisione dei dati, la società deve raccogliere ed elaborare alcuni elementi dei suoi dati personali durante il processo di registrazione. Ciò si riferisce innanzitutto ai seguenti dati:

• nome utente
• password

 La sua password e/o il suo nome utente non saranno visibili in alcun momento a nessun iscritto in ByWay.

La società non rivelerà, né divulgherà in nessun caso la sua password e/o il suo nome utente a terzi. 
Dovrà inoltre indicare i seguenti dati personali durante il processo di registrazione:

• nome;
• cognome;
• ragione sociale
• indirizzo;
• partita IVA o codice fiscale;
• indirizzo di posta elettronica;
• numero di telefono.

I dati personali raccolti sono comunque utilizzati per l’erogazione di servizi e/o informazioni all’utente.

1. Dati per il pagamento

In caso di acquisto dei servizi a pagamento offerti dalla società, quest’ultima raccoglierà e utilizzerà i dati di pagamento, come quelli inerenti la carta di credito o i dati bancari esclusivamente per perfezionare la transazione. Se si seleziona la carta di credito come metodo di pagamento la società tratterà i suoi dati di pagamento unitamente agli altri dati necessari alla fatturazione (ad esempio nome e indirizzo di fatturazione). In tali casi, la società è tenuta a trattare i suoi dati in conformità alla legge italiana applicabile. I dati di pagamento e di fatturazione vengono inviati, raccolti e trattati dai diversi fornitori di servizi come le società di carte di credito al fine di portare a termine il pagamento. Tutti i suoi dati di fatturazione e di pagamento vengono salvati in e mantenuti nella disponibilità della società.

1. Minorenni

L’uso dei servizi di digitalizzazione offerti dalla società è riservato a chi abbia raggiunto la maggiore età (18 anni). I genitori o i tutori legali sono responsabili della protezione della privacy dei minori.

La società si riserva il diritto di modificare, dopo la pubblicazione, i presenti termini e condizioni riguardanti la protezione dei dati, nel caso in cui ciò fosse necessario a causa di lacune nei presenti termini e condizioni relative alla protezione dei dati o nel caso in cui ciò diventasse necessario in relazione a servizi supplementari o modificati forniti dalla società.

The service is provided by the company ByWay srl located in Italy, 39100 Bolzano, Ipazia Str. 2 (hereinafter called the company), and offers digitalization and online document sharing between different users. The protection of your personal data is of utmost concern for the company.In these Terms and Conditions on Data and Document Protection we would like to inform you about the treatment of your personal data and how you can share this data with other "ByWay" users. 1. Basic Principles for “ByWay” for handling your Personal Data

If you chose credit card as your method of payment, the company will process your billing data along with any other details required for billing purposes (e.g. name and billing address). In such cases, the company will process your data in accordance with applicable Italian law. in order to process payments, your billing details are, in the required extent, sent to, collected and processed by service providers such as credit card companies. Your billing details are saved in order to process payments for eventual automatic user account extensions.

Membership of "ByWay" is reserved to persons who have reached the legal age of 18. Parents and legal guardians are responsible for the protection of their children's privacy.

The company reserves the right to amend these Terms and Conditions on Data Protection, in case of gaps in these Terms and Conditions on Data Protection identified only after their release, or in case of additional or amended services provided by the company.

„ByWay“ bezeichnet den Dienst zur Digitalisierung und zum Datenaustausch zwischen verschiedenen Nutzern, welcher von der Firma ByWay GmbH, mit Sitz in Hypatienstraße 2, 39100 Bozen, Italien (im Folgenden ByWay genannt), angeboten wird, und Gegenstand dieses Vertrages ist.

1. Zahlungsdaten

Sofern Sie kostenpflichtige Dienste von ByWay nutzen, werden Ihre Zahlungsdaten (wie Kreditkarten- oder Bankdetails) entsprechend des gewählten Zahlungsmittels von ByWay erhoben und für die Zahlungsabwicklung und Abrechnung verwendet.
Wenn Sie Kreditkarte als Zahlungsmittel wählen, erfolgt die Verarbeitung der Zahlungsdaten und der für die Abwicklung der Zahlung erforderlichen Daten (z. B. Name und Rechnungsanschrift) auch durch ByWay. ByWay verarbeitet Ihre Daten im Rahmen der anwendbaren gesetzlichen Vorschriften in Italien. Falls zur Abwicklung der Transaktion notwendig, werden Ihre Zahlungsdaten an Dienstleister wie z.B. Kreditkarteninstitute übermittelt, bzw. direkt von diesen erhoben, und dort verarbeitet. Ihre Zahlungsdaten werden für die Zahlungsabwicklung und Abrechnung im Falle einer automatischen Verlängerung des Nutzungsverhältnisses gespeichert.

1. Minderjährige

Die Nutzung und Registrierung für die ByWay-Dienste ist ausschließlich volljährigen Personen vorbehalten. Eltern oder Aufsichtsberechtigte sind für den Schutz der Privatsphäre ihrer Kinder verantwortlich.

ByWay behält sich das Recht vor, diese Datenschutzbestimmungen zu ändern, falls erst nach Veröffentlichung des Vertrages Lücken bekannt werden, oder falls ByWay die angebotenen Dienstleistungen verändert oder neue anbietet.
